Welcome to Persimi! By accessing or using our services, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree to these terms, you are not permitted to use our services.

Use of Services

• Eligibility: You must be at least 13 years old to use Persimi. If you are under 18, you must have permission from a parent or guardian who agrees to these terms on your behalf.
• Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
• Permitted Use: You agree to use Persimi only for lawful purposes and not to engage in any fraudulent, harmful, or malicious activities.
• Adult & Sensitive Content: Persimi does not permit the use of AI personas to explore adult, explicit, or otherwise inappropriate content unless it is clearly for professional, academic, or therapeutic purposes and approached respectfully. We reserve the right to restrict content at our sole discretion.
• AI-Generated Content: Persimi uses AI technology powered by OpenAI. Content generated through Persimi is provided “as is,” and may include errors, omissions, or outputs that do not reflect factual accuracy or appropriate advice. You acknowledge and agree that:
  • You are solely responsible for evaluating and using any content generated by the AI.
  • Persimi does not guarantee the accuracy, reliability, or legality of any AI-generated content.
  • You are responsible for any decisions, actions, or consequences resulting from your use of the platform.
  • Persimi disclaims all liability arising from reliance on AI-generated content.
  Persimi acts as a conduit to access and interact with AI models. Persimi does not monitor, moderate, or review the content generated by users or the AI. You understand and agree that your use of AI-generated content is entirely at your own risk.

Intellectual Property

• Ownership: All content and features of Persimi, including text, graphics, logos, and software, are the property of Persimi or our licensors. You may not copy, modify, distribute, or use any part of Persimi without our prior written consent, except as provided by your licensed use of the product.
• Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use Persimi for your personal or internal business purposes, in accordance with these Terms.

User Content

• User-Provided Content: You retain all rights to content you submit, post, or display through Persimi.
• License to Persimi: By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content for the sole purpose of providing and improving our services.
• Content Responsibility: You are fully responsible for the legality, reliability, and appropriateness of the content you create, submit, or engage with on Persimi.You agree not to input or expose the platform to any data, prompts, or materials that you do not have the legal right to use, including copyrighted material, private information, or proprietary data of third parties without consent.

Termination

We reserve the right to limit, suspend, or terminate your access to Persimi at any time, with or without notice, if we believe you have violated these Terms, or to protect the integrity of our services or the safety of others. We may reinstate access at our sole discretion.

Limitation of Liability

Persimi is provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Persimi, its affiliates, and service providers (including OpenAI) shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to your use of the services, even if advised of the possibility of such damages.

This includes, but is not limited to, damages resulting from:

• Inaccurate or misleading AI-generated content
• Decisions or actions taken based on such content
• Service outages or technical issues
• Unauthorized access to or alteration of your data

Indemnification

You agree to indemnify, defend, and hold harmless Persimi, its affiliates, employees, licensors, and service providers from any claims, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the services, your violation of these terms, or your violation of any third-party rights.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, features, or legal obligations. We will notify users of any material changes. Continued use of the service after changes are posted constitutes your acceptance.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, USA. Any dispute or claim related to these Terms or your use of the services shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, and you agree to waive your right to a trial by jury or to participate in a class action. Judgment on the arbitration award may be entered in any court of competent jurisdiction located in North Carolina.
